1. Who We Are

MySongAI is an AI-powered personalized song generation service operated by:

2. Service Description

You submit details about a person and occasion, pay for the order, and our system creates a unique song using artificial intelligence. You receive a high-quality MP3 file and the song lyrics as email attachments, plus a link to listen online.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from MySongAI. By placing an order, you confirm that you meet this requirement.

4. Payment and Delivery

Payment is processed securely through Stripe. Song generation begins after Stripe confirms payment or after a credit is used from your account. Your song is typically ready within 3 minutes; in rare cases of technical issues, delivery may take up to 30 minutes. You will receive the MP3 file and song lyrics as email attachments. A playback link is also available in your dashboard (if logged in).

5. Refund Policy

Because song generation begins immediately after payment or credit use, each order consumes real AI processing costs. Refunds are therefore limited to objective failures:

• Non-delivery — your song was not delivered within 30 minutes of confirmed payment or credit use due to a technical error on our side.
• Technical quality issues — the audio file is unplayable, corrupted, or significantly below acceptable quality.
• Significant deviation — the song substantially ignores the details you provided (wrong name, wrong occasion, wrong language), and a free revision has not resolved the issue.

Free revision first. If you are unhappy with the result, please contact us at support@mysongai.app within 7 days of delivery. We will generate a revised version at no extra cost. If the revised song still meets one of the criteria above, a full refund will be issued.

Refund requests based solely on subjective taste (e.g. you dislike the musical style even though it matches your selected genre and brief) are not eligible.

Approved refunds are processed via Stripe and typically appear within 5–10 business days.

EU: EU consumers: You have a statutory right of withdrawal within 14 days of purchase. By explicitly requesting immediate digital delivery (generation starts right after payment), you acknowledge that this right is waived once the song has been fully delivered, in accordance with Article 16(m) of EU Directive 2011/83/EU.

For credit bundles: the right of withdrawal expires upon the start of generation of the first song from the bundle.

6. Intellectual Property & Usage Rights

Upon purchase, you receive a non-exclusive, worldwide, perpetual license for personal and commercial use of the final audio recording. You may:

• Share the song on social media (TikTok, Instagram, YouTube, etc.)
• Use it in personal or commercial video projects
• Include it in podcasts, presentations, or other media
• Monetize content in which the song appears

Rights to the underlying AI models and infrastructure remain with their respective providers. MySongAI retains the right to use generated songs for service improvement and promotional purposes, unless you explicitly request otherwise by contacting us.

7. Prohibited Use

You may not use MySongAI to generate content that is:

• Hateful, discriminatory, or incites violence
• Defamatory, obscene, or sexually explicit
• In violation of any applicable law or third-party rights
• Intended for harassment or stalking of individuals

We reserve the right to refuse or cancel any order that violates these terms, without a refund if the violation is intentional.

8. Third-Party Data

User declares and warrants that when providing third-party data (e.g. the recipient's name, shared memories), they have obtained explicit consent from those individuals for MySongAI to process their data for the purpose of fulfilling the order. User bears full responsibility for any third-party claims arising from unauthorized use of their personal data in the song generation process.

9. Limitation of Liability

The service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages. Our total liability for any claim arising from use of the service shall not exceed the amount you paid for the specific order in question.

We do not guarantee that AI-generated songs will meet every individual's aesthetic expectations. Where an objective failure occurs as defined in Section 5, we will offer a free revision and, if unresolved, a full refund.

9. General Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Force Majeure: We are not liable for any delays or failures in performance caused by circumstances beyond our reasonable control, including outages of external AI APIs, cloud infrastructure interruptions, natural disasters, governmental actions, or other force majeure events.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top. Continued use of the service after changes constitutes acceptance of the new Terms.

12. Governing Law & Disputes

These Terms are governed by applicable international law. Nothing in these Terms limits the mandatory consumer protection rights you have under the law of your country of residence. If any dispute arises, we encourage you to contact us first at support@mysongai.app — we aim to resolve all issues quickly and fairly.
